Tariff of fees at the Dispute Resolution Centre

I. The parties using the services of the Dispute Resolution Centre Sofia shall pay the fees specified in the Tariff, which are final, in BGN and shall not be subject to VAT.

All fees in the Fee Schedule, except the registration fee, are payable per astronomical hour.

II. CONSULTING FEES for dispute resolution – 80 BGN per hour.

III. MEDIATION FEES

1. The fees for mediation conducted by mediators at the Centre for Dispute Resolution Sofia are:

1.1. The registration fee shall be paid in order to start the mediation procedure. It covers the initial processing and exchange of documents and contacting the parties.

1.2.The fee for mediation in disputes with a material interest, initiated by an application from one party, shall be as follows:

  • up to 25 000 – BGN 100 per hour for civil disputes, BGN 120 per hour for commercial disputes,
  • from BGN 26 000 to BGN 50 000 – BGN 110 per hour for civil disputes, BGN 130 per hour for commercial disputes,
  • • from BGN 51 000 to BGN 100 000 – BGN 120 per hour for civil disputes, BGN 140 per hour for commercial disputes,
  • over BGN 101 000 – BGN 140 per hour + 1% of the material interest..

1.3. The mediation fee for disputes with material interest, commenced with an application jointly by both parties, shall be as follows:

  • up to 25 000 – BGN 90 per hour for civil disputes, BGN 110 per hour for commercial disputes,
  • • from BGN 26 000 to BGN 50 000 – BGN 100 per hour for civil disputes, BGN 120 per hour for commercial disputes,
  • • from BGN 51 000 to BGN 100 000 – BGN 110 per hour for civil disputes, BGN 130 per hour for commercial disputes,
  • over BGN 101 000 – BGN 130 per hour + 1% of the material interest.

1.4. Mediation fee for disputes :

  • No material interest,
  • in family disputes relating to personal relations and maintenance,
  • employment disputes,
  • consumer disputes,
  • administrative disputes,
  • disputes under the EULA

is BGN 100 per hour.

1.5. The fees for disputes with more than two parties, with a complicated legal and factual situation, in cases of public interest, in other specific cases are subject to individual negotiation.

Time frame

2.1. Fees are payable in advance for 2 hours of mediation.

2.2. In the event that the mediation takes longer than 2 hours to reach an agreement, the mediator will give the parties an estimate of how much more time would be needed to complete the mediation. The mediation shall continue after payment for the additional hours.

Scope of fees

3.1. The mediation fees include the organisation and preparation of the mediation, the provision of working space and technical materials, the conduct of the sessions by one or two mediators, depending on the specifics of the case.

3.2. No additional fees shall be charged for administration or for the participation of a second mediator.

Costs

4.1. In the event that it is necessary to incur expenses for the mediation, e.g. translation, transportation and hotel accommodation (in the event of mediation taking place in a location other than the seat of the mediation centre), room rental, etc., such expenses shall be approved and paid by the parties in advance.

4.2. In the event of mediation in another location, travel and preparation time shall be charged at 30% of the hourly rate for the type of mediation.

Allocation of fees and costs between the parties

5.1. The above fees shall apply jointly to both parties and shall be shared equally between the parties or as agreed between them. If necessary, the parties may obtain assistance from the mediators in reaching such an agreement.

5.2. Costs shall be shared equally between the parties or borne by the party requesting the activity to which the costs relate.

Non-commitment to the Agreement

6. Mediation fees are not linked to the agreement reached nor to its implementation. No additional fee shall be payable upon settlement. Settlement drafting is a separate service from mediation.

Payment of fees

7.1. All mediation fees shall be paid in advance, at least 2 days before the date of the mediation session agreed accordingly.

7.2. Fees paid are non-refundable once the first mediation session has commenced. In the event that a party or parties withdraw from the proceedings before the first mediation session has commenced, the fee shall be refunded, with 10% retained for administrative costs.

8. This tariff is effective as of January 5, 2024.
